These Terms of Sale are entered into between Carredas Communication SAS, a simplified joint-stock company with share capital of 38,850 euros, registered at 7 Rue de la Distillerie, ZA de la Plaine, 59493 Villeneuve-d'Ascq, RCS Lille Métropole no. 384 493 094, operating the Websir brand (“Carredas” or the “Provider”), and any natural or legal person subscribing to a Websir subscription (the “Client”).

Purpose and scope

These Terms define the financial and contractual terms applicable to subscription to a website generation, hosting and maintenance service provided through the Websir platform. They supplement the Terms of Use; in case of conflict, these Terms prevail for financial and contractual matters.

Offer description

At this date, the only marketed offer is:

AI Showcase Website — “static” subscription

  • Monthly price: €39.90 excl. tax / month (€47.88 incl. French VAT at 20%).
  • Annual price: €399.00 excl. tax / year, equivalent to €33.25 excl. tax / month (-17% compared with monthly billing).
  • Included: up to 20 published pages, legal pages included; Cloudflare hosting (R2 + Workers); SSL certificate; immediate websir.fr subdomain; connection of a domain owned by the Client; unlimited edits by dialogue with the AI; contact forms; anonymous Cloudflare Web Analytics; email support.
  • Not included: purchase or renewal of external domain names, custom human design or copywriting services, professional translation and third-party API integrations.

The “dynamic” and “ecommerce” offers mentioned on the website are under development and are not marketed at this date.

Order process

Websir follows a freemium model: account creation, AI briefing, site generation and internal preview are free and commitment-free. No payment method is requested at registration. You only pay when publishing your site.

The subscription is triggered when the site is deployed, in the publishing funnel (Payment step). The Client chooses monthly or annual billing, enters any promo code, accepts these Terms and the Terms of Use, is redirected to Stripe for secure payment and returns to Websir after payment validation, which triggers deployment.

The contract is formed when the first payment is effectively debited. A subscription confirmation and invoice are sent by email to the address in the Client account.

Price

Prices are stated in euros, excluding tax and including tax. Applicable VAT is the rate in force on the debit date. Clients established in the European Union with a valid intra-community VAT number may benefit from reverse charge under Directive 2006/112/EC.

Prices cover the service described in the Offer description section. No setup, commissioning or termination fee is charged.

Payment terms

Payment is made exclusively by bank card through Stripe Payments Europe Ltd, PCI-DSS level 1 certified. No banking data is stored on Carredas Communication SAS servers.

Payment is debited immediately for the first period and then automatically renewed on each subscription anniversary at the applicable renewal price. The Client warrants the validity of the saved payment method and undertakes to update it if it expires or changes.

Term and renewal

The subscription is entered into for the chosen billing period (one month or one year) and is automatically renewed for successive periods of the same duration unless terminated under the Termination section.

Withdrawal right

Consumer Clients normally have a fourteen (14) day withdrawal period from conclusion of the contract. However, under Article L. 221-28 13° of the French Consumer Code, the withdrawal right cannot be exercised for contracts for the supply of digital content not provided on a tangible medium where performance has begun after the consumer’s express prior agreement and express waiver of the withdrawal right.

Websir provides immediate digital content: a deployed website, active hosting, subdomain or connected domain. By ticking the relevant box during payment, the Client expressly requests immediate performance before the end of the withdrawal period and acknowledges losing the withdrawal right once the site is deployed.

Termination

By the Client. The Client may terminate the subscription at any time from the customer area or Stripe billing portal. Termination takes effect at the end of the current billing period; the service remains available until then. No pro rata refund is made unless mandatory law provides otherwise.

By Carredas Communication SAS. The Provider may terminate the subscription after an unsuccessful seven (7) day formal notice in case of non-payment, breach of the Terms of Use, fraudulent conduct, false declaration or repeated bypassing of technical limits. In case of serious breach, termination may occur without notice.

Payment default

If a debit fails, Stripe retries payment several times over a maximum of seven (7) days and notifies the Client by email. Without regularization, the subscription is suspended: the site stops being served on its publication domain while account data remains accessible. Without regularization after thirty (30) days of suspension, the subscription is terminated automatically; site data remains recoverable for a further thirty (30) days, then is permanently deleted.

Price changes

Carredas Communication SAS may change prices at any time. Changes apply to new subscriptions and existing subscriptions at the next renewal. The Client is informed by email at least one month before the change takes effect and may terminate free of charge before the new price applies.

Legal warranties

Consumer Clients benefit from statutory warranties under Articles L. 217-3 et seq. of the French Consumer Code for digital content and services, and Articles 1641 et seq. of the French Civil Code for hidden defects. Where legally required, the Client may request correction, a conforming service, price reduction or contract termination.

Personal data and billing

Data collected during subscription is processed according to the Privacy Policy. Invoices and accounting data are retained for ten (10) years under Article L. 123-22 of the French Commercial Code. Banking data is processed exclusively by Stripe and never stored by Carredas Communication SAS.

Consumer mediation

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, a consumer Client may use a consumer mediator free of charge if a dispute remains unresolved after a prior written complaint to customer support at [email protected].

The consumer Client may also file a complaint on the European Commission online dispute resolution platform: ec.europa.eu/consumers/odr.

Governing law and jurisdiction

These Terms are governed by French law. Failing amicable resolution or successful mediation, disputes relating to their formation, interpretation, performance or termination will be submitted to the competent courts under ordinary law. Consumer Clients may use the territorially competent courts provided by the French Consumer Code.
