Terms of Use — Websir

These Terms of Use govern access to and use of the Websir service, operated by Carredas Communication SAS, registered at 7 Rue de la Distillerie, ZA de la Plaine, 59493 Villeneuve-d'Ascq, and available at www.websir.fr.

By creating an account or using the service, the user accepts these Terms without reservation. Financial terms are governed by the Terms of Sale when a paid subscription is taken out.

Purpose

These Terms define the conditions for accessing and using Websir, and the rights and obligations of the parties in that context.

Service description

Websir is an AI-powered no-code SaaS platform. The user describes their need in natural language through a chat interface; an AI system generates a complete static website (structure, design, copy, code and images), then deploys it on Cloudflare’s content delivery network.

hosting on Cloudflare infrastructure (R2 + Workers);
immediate availability of a websir.fr subdomain and connection of a user-owned custom domain;
automatic SSL certificate issuance and renewal;
site edits requested through dialogue with the AI;
integrated contact forms, anonymous Cloudflare Web Analytics and email support.

The “dynamic” and “e-commerce” offers mentioned on the site are under development and are not marketed at this date.

Access and user account

Access requires an account. Registration is available by email and password or through a third-party identity provider (Google, Facebook, Apple), as described in the Privacy Policy.

The user must be at least 16 years old and have legal capacity to enter into a contract. If acting on behalf of a legal entity, the user warrants that they have authority to bind it. The user is responsible for the confidentiality of their credentials and for actions carried out from their account.

Free use and payment trigger

Websir works on a freemium model. Account creation, briefing the AI, full site generation and internal preview are free and commitment-free. No payment method is requested at registration. You only pay when publishing your site.

Until deployment, the site is available only as a private preview from the user account. Publishing on a websir.fr subdomain or custom domain triggers the paid subscription governed by the Terms of Sale.

Usage rules

The user must use the service in accordance with its purpose, these Terms and applicable law. In particular, the following are prohibited:

creating sites with illegal, hateful, violent, defamatory, harassing, pornographic or otherwise unlawful content;
infringing third-party rights such as copyright, trademarks, image rights, privacy or trade secrets;
fraudulent activities, phishing, counterfeiting, scams, false identity or sale of illegal or regulated products without authorization;
malware distribution, cryptocurrency mining, massive scraping or attacks on information systems;
spam, unlawful commercial prospecting or attempts to bypass platform limits and security mechanisms;
prompt-injection or social engineering attempts aimed at extracting internal prompts, producing prohibited content or forcing model self-references.

User-generated content

The user is solely responsible for content they generate or upload through the platform, including briefs, text, images, logos and files attached to forms. The user warrants that they hold all necessary rights and indemnifies Carredas Communication SAS against third-party claims.

The user retains ownership of their content and grants Carredas Communication SAS a free, non-exclusive license to host, technically adapt, reproduce and display it solely to provide the service.

AI generation specifics

The site is produced by a generative AI system relying on third-party language models. The user acknowledges that generated content may contain errors, approximations or accidental similarities with other works, and must be reviewed before publication. Some structured data such as phone number, address, SIRET, host and company name is never sent to the model and is injected locally at deployment through typed variables.

Carredas Communication SAS implements reasonable filtering and verification measures; final editorial responsibility for the published site remains with the user.

Hosting provider status

Carredas Communication SAS acts as a hosting provider within the meaning of Article 6-I-2 of the LCEN for content stored and published through the platform. It is not subject to a general monitoring obligation but will promptly remove manifestly illegal content once it has actual knowledge of it.

Illegal content can be reported to [email protected] under the procedure described in the Legal notice.

Service availability

Carredas Communication SAS aims to keep the service available 24/7, with a 99.5% monthly availability target excluding planned interruptions. The service may be interrupted for maintenance, updates, subprocessor failure or force majeure.

Suspension and account closure

Carredas Communication SAS may suspend or delete, without notice or compensation, any account that breaches these Terms, including prohibited use, repeated bypass attempts, non-payment or provision of manifestly inaccurate information. The user may delete their account at any time through the Data deletion process.

Intellectual property

The Websir platform, source code, design, databases, brand and logos are the exclusive property of Carredas Communication SAS. Use of the service grants the user only a personal, non-exclusive and non-transferable right to use the platform during service use. For generated sites and their code, the user receives a usage right including static source export for hosting on third-party infrastructure, subject to compliance with these Terms and the Terms of Sale.

Liability

Carredas Communication SAS uses reasonable means to ensure service quality, security and continuity and is generally bound by an obligation of means, not result. Liability is limited to direct, certain and foreseeable damage caused by a proven contractual breach, excluding indirect damage, and capped at the total amount paid by the user during the twelve months preceding the event giving rise to liability, except where mandatory law provides otherwise.

Changes to these Terms

Carredas Communication SAS may modify these Terms at any time. Users will be informed of substantial changes by email or in-app notification with reasonable notice. Continued use after the effective date constitutes acceptance.

Governing law and jurisdiction

These Terms are governed by French law. Failing amicable resolution, disputes relating to their formation, interpretation or performance will be brought before the competent courts under ordinary law, subject to mandatory consumer protection provisions.
